Algemene voorwaarden van Mts. Communication in Practice, St Annastraat 404, 6525 ZM Nijmegen, ingeschreven bij de Kamer van Koophandel onder nummer 59750448. Versie: oktober 2026.

Artikel 1 Definities

In deze voorwaarden wordt verstaan onder:

  • Ondernemer: Mts. Communication in Practice, KvK 59750448, btw-nummer NL853629523B01, St Annastraat 404, 6525 ZM Nijmegen, e-mail info@communicationinpractice.com, telefoon +31 (0)622604319.
  • Consument: de natuurlijke persoon die niet handelt in de uitoefening van een beroep of bedrijf en een overeenkomst op afstand aangaat met de ondernemer.
  • Zakelijke koper: iedere koper die geen consument is.
  • Koper: de consument of de zakelijke koper.
  • Webshop: de website communicationinpractice.com in al zijn taalversies.
  • Product: een boek of ander fysiek product dat de ondernemer via de webshop aanbiedt.
  • Overeenkomst op afstand: een overeenkomst die tussen de ondernemer en de koper tot stand komt via de webshop en e-mail, zonder gelijktijdige fysieke aanwezigheid.
  • Bedenktijd: de termijn waarbinnen de consument gebruik kan maken van zijn herroepingsrecht.
  • Herroepingsfunctie: het online formulier op de webshop waarmee de consument de overeenkomst kan herroepen (artikel 6).
  • Duurzame drager: elk hulpmiddel dat de koper of de ondernemer in staat stelt persoonlijk aan hem gerichte informatie zo op te slaan dat deze later onveranderd kan worden geraadpleegd, zoals e-mail.
  • Dagen: kalenderdagen.

Artikel 2 Toepasselijkheid

2.1 Deze voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke overeenkomst op afstand tussen de ondernemer en de koper.

2.2 Voordat de overeenkomst wordt gesloten, wordt de tekst van deze voorwaarden aan de koper beschikbaar gesteld. De koper kan de voorwaarden op een eenvoudige manier opslaan op een duurzame drager, bijvoorbeeld door ze te downloaden of af te drukken. Op verzoek stuurt de ondernemer ze kosteloos toe. De koper aanvaardt de voorwaarden bij het afrekenen door het daarvoor bestemde vakje aan te vinken.

2.3 Afwijkingen van deze voorwaarden zijn alleen geldig als de ondernemer en de koper dat schriftelijk, ook per e-mail, zijn overeengekomen.

2.4 Algemene voorwaarden van de zakelijke koper zijn niet van toepassing, ook niet als de zakelijke koper daar bij zijn bestelling naar verwijst.

2.5 Is een bepaling uit deze voorwaarden nietig of wordt zij vernietigd, dan blijven de overige bepalingen volledig van kracht. De ondernemer en de koper overleggen dan over een nieuwe bepaling die de strekking van de oorspronkelijke zo veel mogelijk benadert.

2.6 Situaties die niet in deze voorwaarden zijn geregeld, worden beoordeeld in de geest van deze voorwaarden.

Artikel 3 Het aanbod

3.1 Het aanbod bevat een volledige en nauwkeurige omschrijving van de producten: titel, auteurs, taal van het boek, prijs en eventuele andere kenmerken. De omschrijving is voldoende gedetailleerd om de koper een goede beoordeling mogelijk te maken. Afbeeldingen zijn een waarheidsgetrouwe weergave van de producten; kleine kleurafwijkingen kunnen voorkomen.

3.2 Het aanbod is vrijblijvend en geldt zolang de voorraad strekt. Bij kennelijke vergissingen of verschrijvingen in het aanbod, zoals een evident onjuiste prijs, is de ondernemer niet aan het aanbod gebonden.

3.3 Bij elk aanbod wordt duidelijk gemaakt welke rechten en plichten voor de koper aan het aanvaarden van het aanbod verbonden zijn.

3.4 De overeenkomst kan in het Nederlands of in het Engels worden gesloten. Voor zover het dwingend recht niet anders bepaalt, geldt bij verschillen tussen de taalversies van deze voorwaarden de Nederlandse tekst.

Artikel 4 De overeenkomst

4.1 De overeenkomst komt tot stand op het moment dat de koper het aanbod aanvaardt door de bestelling te plaatsen met de knop die een betalingsverplichting aangeeft, en aan de daarbij gestelde voorwaarden is voldaan.

4.2 De ondernemer bevestigt de ontvangst van de bestelling zo snel mogelijk elektronisch. Ontvangt de koper geen bevestiging, dan kan hij contact opnemen met de ondernemer.

4.3 De ondernemer mag binnen de wettelijke kaders nagaan of de koper aan zijn betalingsverplichting kan voldoen en of er andere feiten en factoren zijn die van belang zijn voor het verantwoord aangaan van de overeenkomst. Heeft de ondernemer op grond daarvan een goede reden om de overeenkomst niet aan te gaan, dan mag hij een bestelling gemotiveerd weigeren of er bijzondere voorwaarden aan verbinden.

4.4 Uiterlijk bij de levering van het product stuurt de ondernemer de koper op een duurzame drager (in elk geval in de orderbevestiging) de volgende informatie: het bezoekadres van de ondernemer waar de koper met klachten terecht kan, de voorwaarden en de wijze waarop de koper gebruik kan maken van het herroepingsrecht, informatie over service en bestaande garanties, en de gegevens die in artikel 9 over klachten staan.

Artikel 5 Prijs en betaling

5.1 Alle prijzen zijn in euro’s en inclusief btw (voor boeken het verlaagde tarief), tenzij anders vermeld. Verzendkosten komen daar bovenop. De verzendkosten worden per bestemming getoond voordat de koper de bestelling plaatst.

5.2 De prijs die op het moment van de bestelling in de webshop staat, geldt voor die bestelling. Voor Nederlandstalige boeken zijn de prijzen vaste boekenprijzen in de zin van de Wet op de vaste boekenprijs; de ondernemer kan daarop dus niet zomaar korting geven.

5.3 De koper betaalt vooraf, bij het plaatsen van de bestelling, met een van de betaalmethoden die bij het afrekenen worden aangeboden, zoals iDEAL of creditcard. Betalingen lopen via Mollie B.V. De ondernemer verwerkt de bestelling pas nadat de betaling is ontvangen.

5.4 De koper meldt onjuistheden in verstrekte of vermelde betaalgegevens onverwijld aan de ondernemer.

5.5 Wordt de betaling niet voltooid, bijvoorbeeld omdat de betaling is geweigerd, geannuleerd of verlopen, dan komt de bestelling te vervallen en is de ondernemer niet verplicht te leveren.

5.6 Na de bestelling ontvangt de koper een orderbevestiging met de btw gespecificeerd. Een zakelijke koper die een factuur op naam of met een btw-nummer wil, geeft deze gegevens bij de bestelling door of stuurt ze direct daarna naar info@communicationinpractice.com.

Artikel 6 Herroepingsrecht (alleen voor consumenten)

6.1 De consument kan een overeenkomst voor de koop van een product gedurende veertien dagen zonder opgave van redenen ontbinden. Deze bedenktijd gaat in op de dag nadat de consument, of een door de consument aangewezen derde die niet de vervoerder is, het product heeft ontvangen. Bestelt de consument meerdere producten in één bestelling die apart worden geleverd, dan gaat de bedenktijd in op de dag nadat de consument het laatste product heeft ontvangen.

6.2 Tijdens de bedenktijd gaat de consument zorgvuldig om met het product en de verpakking. Hij pakt het product alleen uit of gebruikt het alleen voor zover dat nodig is om vast te stellen of hij het product wil houden, zoals hij dat ook in een winkel zou doen.

6.3 Wil de consument gebruikmaken van zijn herroepingsrecht, dan meldt hij dit binnen de bedenktijd aan de ondernemer. Dat kan op twee manieren: via de herroepingsfunctie op de webshop (https://communicationinpractice.com/herroepen-withdraw/), waar hij zijn naam, ordernummer en e-mailadres invult en daarna op de knop “herroeping bevestigen” klikt, of met een ondubbelzinnige verklaring per e-mail of per post, bijvoorbeeld met het modelformulier hieronder. Na de melding ontvangt de consument direct een ontvangstbevestiging per e-mail, met de inhoud van de melding en de datum en het tijdstip waarop deze is gedaan.

6.4 Na de melding stuurt de consument het product zo snel mogelijk, en uiterlijk binnen veertien dagen, terug naar het retouradres van de ondernemer: Mts. Communication in Practice, St Annastraat 404, 6525 ZM Nijmegen. De consument stuurt het product terug in de originele staat en verpakking, voor zover dat redelijkerwijs mogelijk is, en volgt daarbij de redelijke en duidelijke aanwijzingen van de ondernemer. De terugzendtermijn is in acht genomen als het product vóór het einde van de termijn is verzonden.

6.5 De consument draagt het risico en de bewijslast voor de juiste en tijdige uitoefening van het herroepingsrecht.

6.6 De kosten van het terugsturen van het product zijn voor rekening van de consument. Die kosten hangen af van het land en de vervoerder en zijn voor een boek binnen Nederland en België doorgaans vergelijkbaar met de verzendkosten die u bij uw bestelling betaalde.

6.7 Na een herroeping betaalt de ondernemer alle betalingen van de consument, inclusief de standaard verzendkosten, zonder vertraging en uiterlijk binnen veertien dagen na de melding van de herroeping terug. De ondernemer mag wachten met terugbetalen tot hij het product heeft ontvangen, of tot de consument aantoont dat hij het product heeft teruggestuurd, al naargelang welk moment eerder valt. Terugbetaling gebeurt met hetzelfde betaalmiddel als waarmee de consument heeft betaald, tenzij hij uitdrukkelijk instemt met een andere methode, en zonder kosten voor de consument. Heeft de consument gekozen voor een duurdere levering dan de goedkoopste standaardlevering, dan betaalt de ondernemer de meerkosten niet terug.

6.8 De consument is aansprakelijk voor waardevermindering van het product als die het gevolg is van een manier van omgaan met het product die verder gaat dan in artikel 6.2 is toegestaan. Heeft de ondernemer de consument vóór het sluiten van de overeenkomst niet alle wettelijk verplichte informatie over het herroepingsrecht gegeven, dan is de consument niet aansprakelijk voor waardevermindering.

6.9 De ondernemer biedt op dit moment geen producten aan waarvoor het herroepingsrecht is uitgesloten.

Artikel 7 Levering en uitvoering

7.1 De ondernemer neemt de grootst mogelijke zorgvuldigheid in acht bij het in ontvangst nemen en uitvoeren van bestellingen.

7.2 Als plaats van aflevering geldt het adres dat de koper aan de ondernemer heeft doorgegeven. De ondernemer levert in Nederland, België en de overige landen van de Europese Unie. Levering buiten de Europese Unie is niet mogelijk.

7.3 De ondernemer voert geaccepteerde bestellingen zo snel mogelijk uit, uiterlijk binnen dertig dagen na de bestelling, tenzij een andere leveringstermijn is overeengekomen. De ondernemer streeft ernaar bestellingen binnen enkele werkdagen te verzenden.

7.4 Duurt de levering langer, of kan een bestelling niet of slechts gedeeltelijk worden uitgevoerd, dan krijgt de koper daarvan uiterlijk dertig dagen na de bestelling bericht. De consument heeft in dat geval het recht de overeenkomst zonder kosten te ontbinden en krijgt zijn betaling zo snel mogelijk terug, uiterlijk binnen veertien dagen na de ontbinding.

7.5 Is een bestelde titel niet leverbaar, dan spant de ondernemer zich in een vervangend product aan te bieden. Dat wordt uiterlijk bij de levering duidelijk en begrijpelijk gemeld en de consument houdt het herroepingsrecht. De kosten van een eventuele retourzending zijn dan voor rekening van de ondernemer.

7.6 Het risico van beschadiging of verlies van het product ligt bij de ondernemer tot het moment van aflevering aan de koper of een vooraf aangewezen en aan de ondernemer bekendgemaakte vertegenwoordiger, tenzij uitdrukkelijk anders is overeengekomen. Zichtbare transportschade meldt de koper zo snel mogelijk, bij voorkeur met een foto.

Artikel 8 Conformiteit en garantie (consumenten)

8.1 De ondernemer staat ervoor in dat de producten voldoen aan de overeenkomst, aan de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en bruikbaarheid en aan de wettelijke bepalingen die gelden op de dag van het sluiten van de overeenkomst.

8.2 Een gebrek meldt de consument binnen bekwame tijd nadat hij het heeft ontdekt. Een melding binnen twee maanden na ontdekking geldt in ieder geval als tijdig.

8.3 Voldoet het product niet aan de overeenkomst, dan herstelt of vervangt de ondernemer het product kosteloos binnen een redelijke termijn en zonder grote overlast voor de consument. Is herstel of vervanging niet mogelijk of niet redelijk, dan heeft de consument recht op een passende prijsvermindering of op ontbinding van de overeenkomst.

8.4 Dit artikel doet niets af aan de wettelijke rechten van de consument. Garantie vervalt niet bij normaal gebruik, maar wel als het gebrek is veroorzaakt door onzorgvuldig of oneigenlijk gebruik door de koper of een derde.

Artikel 9 Klachten

9.1 Klachten over de uitvoering van de overeenkomst dient de koper binnen bekwame tijd, volledig en duidelijk omschreven, in bij de ondernemer via info@communicationinpractice.com of per post op St Annastraat 404, 6525 ZM Nijmegen.

9.2 De ondernemer beantwoordt klachten binnen veertien dagen na ontvangst. Is voor een inhoudelijk antwoord meer tijd nodig, dan krijgt de koper binnen die termijn een ontvangstbevestiging en een indicatie van wanneer hij een uitgebreider antwoord kan verwachten.

9.3 Komen de koper en de ondernemer er samen niet uit, dan ontstaat een geschil dat valt onder artikel 15. Consumenten in andere EU-landen kunnen terecht bij het Europees Consumenten Centrum in hun eigen land.

Artikel 10 Zakelijke kopers

10.1 Dit artikel geldt alleen voor zakelijke kopers. Artikel 6 (herroepingsrecht) en artikel 8 (conformiteit en garantie voor consumenten) gelden niet voor zakelijke kopers.

10.2 De zakelijke koper onderzoekt de producten direct na aflevering. Zichtbare gebreken en afwijkingen in aantal meldt hij binnen acht dagen na aflevering, andere gebreken binnen acht dagen nadat hij ze heeft ontdekt of had kunnen ontdekken. Meldt hij een gebrek te laat, dan vervalt zijn recht op herstel, vervanging of schadevergoeding.

10.3 Is een klacht terecht, dan kiest de ondernemer tussen vervanging, herstel of creditering van het product.

10.4 Genoemde levertijden zijn indicatief. Overschrijding van een levertijd geeft de zakelijke koper geen recht op schadevergoeding of ontbinding, tenzij de ondernemer na een schriftelijke ingebrekestelling met een redelijke termijn nog steeds niet levert.

10.5 De zakelijke koper betaalt vooraf, tenzij schriftelijk is overeengekomen dat hij op factuur mag betalen. Een factuur wordt dan betaald binnen veertien dagen na factuurdatum. Na het verstrijken van die termijn is de zakelijke koper van rechtswege in verzuim en is hij de wettelijke handelsrente verschuldigd, plus de buitengerechtelijke incassokosten volgens het Besluit vergoeding voor buitengerechtelijke incassokosten.

10.6 Geleverde producten blijven eigendom van de ondernemer tot de zakelijke koper alles heeft betaald wat hij voor die producten verschuldigd is.

10.7 Retourzendingen van zakelijke kopers worden alleen aangenomen na voorafgaande schriftelijke toestemming van de ondernemer.

Artikel 11 Aansprakelijkheid

11.1 Voor consumenten geldt de aansprakelijkheid van de ondernemer zoals de wet die regelt. Niets in deze voorwaarden beperkt rechten van de consument die dwingend uit de wet voortvloeien.

11.2 De aansprakelijkheid van de ondernemer jegens een zakelijke koper is beperkt tot directe schade en tot maximaal het factuurbedrag, exclusief btw, van de bestelling waarop de aansprakelijkheid betrekking heeft. De ondernemer is niet aansprakelijk voor indirecte schade, gevolgschade, gederfde winst of bedrijfsschade. Deze beperking geldt niet bij opzet of bewuste roekeloosheid van de ondernemer.

11.3 De boeken zijn bedoeld als algemene professionele informatie voor mensen die werken in de diergeneeskunde en vervangen niet het eigen oordeel van de lezer in een concrete situatie. De ondernemer en de auteurs staan, voor zover de wet dat toelaat, niet in voor de geschiktheid van de inhoud voor een bepaalde individuele situatie.

Artikel 12 Overmacht

12.1 Als de ondernemer door overmacht niet aan zijn verplichtingen kan voldoen, zijn die verplichtingen opgeschort zolang de overmacht duurt. Onder overmacht vallen onder meer storingen in het transport, uitval van een drukker of leverancier, stakingen, storingen van internet of betaaldiensten en overheidsmaatregelen.

12.2 Duurt de overmacht langer dan dertig dagen, dan kunnen de koper en de ondernemer de overeenkomst ontbinden. De ondernemer betaalt dan wat de koper al betaald heeft zo snel mogelijk terug. Over en weer bestaat geen recht op schadevergoeding.

Artikel 13 Intellectuele eigendom

Het auteursrecht en andere intellectuele eigendomsrechten op de boeken, de teksten, de afbeeldingen en de webshop liggen bij de ondernemer of de auteurs. Zonder voorafgaande schriftelijke toestemming mag niets daarvan worden verveelvoudigd, openbaar gemaakt of voor commerciële doeleinden gebruikt, behalve voor zover de wet dat toestaat.

Artikel 14 Privacy

De ondernemer verwerkt persoonsgegevens van de koper volgens de privacyverklaring op https://communicationinpractice.com/privacyverklaring-privacy-statement/. Die verklaring maakt geen deel uit van deze voorwaarden maar legt uit welke gegevens de ondernemer gebruikt en waarom.

Artikel 15 Toepasselijk recht en geschillen

15.1 Op alle overeenkomsten tussen de ondernemer en de koper is Nederlands recht van toepassing. Het Verdrag der Verenigde Naties inzake internationale koopovereenkomsten (Weens Koopverdrag) is uitgesloten.

15.2 Een consument die in een ander EU-land woont, behoudt de bescherming van de dwingende bepalingen van het recht van zijn woonland.

15.3 Geschillen met zakelijke kopers worden voorgelegd aan de rechtbank Gelderland, locatie Nijmegen. Voor geschillen met consumenten geldt de bevoegdheid die de wet aan de consument toekent.

Artikel 16 Wijziging en slotbepalingen

16.1 Op een bestelling is de versie van deze voorwaarden van toepassing die gold op het moment van de bestelling. De ondernemer kan de voorwaarden voor toekomstige bestellingen wijzigen.

General terms and conditions of Mts. Communication in Practice, St Annastraat 404, 6525 ZM Nijmegen, the Netherlands, registered with the Dutch Chamber of Commerce under number 59750448. Version: October 2026.

Article 1 Definitions

In these terms and conditions the following terms mean:

  • Trader: Mts. Communication in Practice, Chamber of Commerce 59750448, VAT number NL853629523B01, St Annastraat 404, 6525 ZM Nijmegen, the Netherlands, email info@communicationinpractice.com, telephone +31 (0)622604319.
  • Consumer: a natural person who does not act in the course of a profession or business and enters into a distance contract with the trader.
  • Business customer: any customer who is not a consumer.
  • Customer: the consumer or the business customer.
  • Webshop: the website communicationinpractice.com in all its language versions.
  • Product: a book or other physical product that the trader offers through the webshop.
  • Distance contract: a contract concluded between the trader and the customer through the webshop and email, without the simultaneous physical presence of both parties.
  • Cooling off period: the period within which the consumer can exercise the right of withdrawal.
  • Withdrawal function: the online form on the webshop with which the consumer can withdraw from the contract (article 6).
  • Durable medium: any means that enables the customer or the trader to store personally addressed information in a way that allows it to be consulted unchanged later, such as email.
  • Days: calendar days.

Article 2 Applicability

2.1 These terms and conditions apply to every offer of the trader and to every distance contract between the trader and the customer.

2.2 Before the contract is concluded, the text of these terms and conditions is made available to the customer. The customer can easily store them on a durable medium, for example by downloading or printing them. On request the trader sends them free of charge. The customer accepts the terms and conditions at checkout by ticking the box provided for that purpose.

2.3 Deviations from these terms and conditions are only valid if the trader and the customer have agreed to them in writing, including by email.

2.4 General terms and conditions of the business customer do not apply, even if the business customer refers to them when ordering.

2.5 If a provision of these terms and conditions is void or is annulled, the other provisions remain fully in force. The trader and the customer will then consult on a new provision that comes as close as possible to the purpose of the original one.

2.6 Situations that are not covered by these terms and conditions are assessed in the spirit of these terms and conditions.

Article 3 The offer

3.1 The offer contains a complete and accurate description of the products: title, authors, language of the book, price and any other characteristics. The description is detailed enough to allow the customer to assess the product properly. Images are a truthful representation of the products; small colour differences may occur.

3.2 The offer is without obligation and is valid while stock lasts. In the case of obvious mistakes or errors in the offer, such as a clearly incorrect price, the trader is not bound by the offer.

3.3 Each offer makes clear what rights and obligations are attached to accepting the offer.

3.4 The contract can be concluded in Dutch or in English. Insofar as mandatory law does not provide otherwise, the Dutch text prevails if the language versions of these terms and conditions differ.

Article 4 The contract

4.1 The contract is concluded when the customer accepts the offer by placing the order with the button that indicates an obligation to pay, and the conditions set for that have been met.

4.2 The trader confirms receipt of the order electronically as soon as possible. If the customer does not receive a confirmation, he can contact the trader.

4.3 Within the limits of the law, the trader may check whether the customer is able to meet his payment obligation and whether there are other facts and factors that are relevant for entering into the contract responsibly. If the trader has good reason on that basis not to enter into the contract, he may refuse an order, giving reasons, or attach special conditions to it.

4.4 At the latest upon delivery of the product the trader sends the customer, on a durable medium (in any case in the order confirmation), the following information: the visiting address of the trader where the customer can submit complaints, the conditions and the way in which the customer can exercise the right of withdrawal, information about service and existing guarantees, and the information about complaints set out in article 9.

Article 5 Price and payment

5.1 All prices are in euros and include VAT (for books the reduced rate), unless stated otherwise. Shipping costs are added to that. The shipping costs are shown per destination before the customer places the order.

5.2 The price shown in the webshop at the time of the order applies to that order. For Dutch language books the prices are fixed book prices within the meaning of the Dutch Fixed Book Price Act, so the trader cannot simply give discounts on them.

5.3 The customer pays in advance, when placing the order, with one of the payment methods offered at checkout, such as iDEAL or credit card. Payments are processed by Mollie B.V. The trader processes the order only after the payment has been received.

5.4 The customer reports any inaccuracies in payment details provided or stated to the trader without delay.

5.5 If the payment is not completed, for example because it is refused, cancelled or expired, the order lapses and the trader is not obliged to deliver.

5.6 After the order the customer receives an order confirmation with the VAT specified. A business customer who wants an invoice in a specific name or with a VAT number provides these details with the order or sends them to info@communicationinpractice.com immediately afterwards.

Article 6 Right of withdrawal (consumers only)

6.1 The consumer can withdraw from a contract for the purchase of a product within fourteen days without giving a reason. This cooling off period starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product. If the consumer orders several products in one order that are delivered separately, the cooling off period starts on the day after the consumer has received the last product.

6.2 During the cooling off period the consumer handles the product and its packaging with care. He unpacks or uses the product only to the extent necessary to establish whether he wishes to keep it, as he would be allowed to do in a shop.

6.3 If the consumer wishes to exercise his right of withdrawal, he notifies the trader within the cooling off period. This can be done in two ways: through the withdrawal function on the webshop (https://communicationinpractice.com/herroepen-withdraw/), where he enters his name, order number and email address and then clicks the button “confirm withdrawal”, or with an unequivocal statement by email or post, for example by using the model form below. After the notification the consumer immediately receives an acknowledgement of receipt by email, stating the content of the notification and the date and time at which it was made.

6.4 After the notification the consumer returns the product as soon as possible, and at the latest within fourteen days, to the return address of the trader: Mts. Communication in Practice, St Annastraat 404, 6525 ZM Nijmegen, the Netherlands. The consumer returns the product in its original condition and packaging, insofar as reasonably possible, and follows the reasonable and clear instructions of the trader. The return period is met if the product is sent back before the end of the period.

6.5 The consumer bears the risk and the burden of proof for the correct and timely exercise of the right of withdrawal.

6.6 The costs of returning the product are borne by the consumer. These costs depend on the country and the carrier and for a book within the Netherlands and Belgium are generally comparable to the shipping costs you paid with your order.

6.7 After a withdrawal the trader refunds all payments of the consumer, including the standard shipping costs, without delay and at the latest within fourteen days after the notification of the withdrawal. The trader may wait with the refund until he has received the product, or until the consumer has shown that he has sent the product back, whichever is earlier. The refund is made with the same payment method that the consumer used, unless he expressly agrees to a different method, and at no cost to the consumer. If the consumer has chosen a more expensive delivery than the cheapest standard delivery, the trader does not refund the extra costs.

6.8 The consumer is liable for any diminished value of the product that results from handling the product beyond what is permitted in article 6.2. If the trader has not given the consumer all legally required information about the right of withdrawal before the contract was concluded, the consumer is not liable for diminished value.

6.9 The trader currently offers no products for which the right of withdrawal is excluded.

Article 7 Delivery and performance

7.1 The trader takes the greatest possible care when receiving and carrying out orders.

7.2 The place of delivery is the address that the customer has given to the trader. The trader delivers in the Netherlands, Belgium and the other countries of the European Union. Delivery outside the European Union is not possible.

7.3 The trader carries out accepted orders as soon as possible, at the latest within thirty days after the order, unless a different delivery period has been agreed. The trader aims to ship orders within a few working days.

7.4 If delivery takes longer, or if an order cannot be carried out or can only be carried out in part, the customer is informed at the latest thirty days after the order. In that case the consumer has the right to dissolve the contract at no cost and receives his payment back as soon as possible, at the latest within fourteen days after the dissolution.

7.5 If an ordered title is not available, the trader will endeavour to offer a replacement product. This is clearly and comprehensibly reported at the latest upon delivery, and the consumer keeps the right of withdrawal. The costs of any return shipment are then borne by the trader.

7.6 The risk of damage to or loss of the product lies with the trader until the moment of delivery to the customer or to a representative designated in advance and made known to the trader, unless expressly agreed otherwise. The customer reports visible transport damage as soon as possible, preferably with a photo.

Article 8 Conformity and guarantee (consumers)

8.1 The trader guarantees that the products conform to the contract, to the specifications stated in the offer, to the reasonable requirements of soundness and usability and to the statutory provisions that applied on the day the contract was concluded.

8.2 The consumer reports a defect within a reasonable time after he has discovered it. A report within two months after discovery is in any case considered timely.

8.3 If the product does not conform to the contract, the trader repairs or replaces the product free of charge within a reasonable period and without major inconvenience to the consumer. If repair or replacement is not possible or not reasonable, the consumer is entitled to an appropriate price reduction or to dissolution of the contract.

8.4 This article does not affect the statutory rights of the consumer. The guarantee does not lapse through normal use, but it does if the defect was caused by careless or improper use by the customer or a third party.

Article 9 Complaints

9.1 The customer submits complaints about the performance of the contract within a reasonable time, fully and clearly described, to the trader at info@communicationinpractice.com or by post at St Annastraat 404, 6525 ZM Nijmegen, the Netherlands.

9.2 The trader answers complaints within fourteen days of receipt. If a substantive answer requires more time, the customer receives within that period an acknowledgement of receipt and an indication of when he can expect a fuller answer.

9.3 If the customer and the trader cannot resolve the matter together, a dispute arises that is governed by article 15. Consumers in other EU countries can turn to the European Consumer Centre in their own country.

Article 10 Business customers

10.1 This article applies to business customers only. Article 6 (right of withdrawal) and article 8 (conformity and guarantee for consumers) do not apply to business customers.

10.2 The business customer inspects the products immediately after delivery. He reports visible defects and differences in quantity within eight days after delivery, and other defects within eight days after he has discovered them or could have discovered them. If he reports a defect too late, his right to repair, replacement or damages lapses.

10.3 If a complaint is justified, the trader chooses between replacement, repair or crediting of the product.

10.4 Stated delivery times are indicative. Exceeding a delivery time gives the business customer no right to damages or dissolution, unless the trader still fails to deliver after a written notice of default with a reasonable period.

10.5 The business customer pays in advance, unless it has been agreed in writing that he may pay on invoice. An invoice is then paid within fourteen days of the invoice date. After that period the business customer is in default by operation of law and owes statutory commercial interest, plus extrajudicial collection costs in accordance with the Dutch Decree on compensation for extrajudicial collection costs.

10.6 Delivered products remain the property of the trader until the business customer has paid everything he owes for those products.

10.7 Returns from business customers are accepted only with the prior written consent of the trader.

Article 11 Liability

11.1 For consumers the liability of the trader is as provided by law. Nothing in these terms and conditions limits rights of the consumer that follow from mandatory law.

11.2 The liability of the trader towards a business customer is limited to direct damage and to a maximum of the invoice amount, excluding VAT, of the order to which the liability relates. The trader is not liable for indirect damage, consequential damage, lost profit or business interruption. This limitation does not apply in the case of intent or deliberate recklessness of the trader.

11.3 The books are intended as general professional information for people working in veterinary medicine and do not replace the reader’s own judgement in a specific situation. To the extent permitted by law, the trader and the authors do not guarantee that the content is suitable for a particular individual situation.

Article 12 Force majeure

12.1 If the trader cannot fulfil his obligations due to force majeure, those obligations are suspended for as long as the force majeure lasts. Force majeure includes, among other things, transport disruptions, failure of a printer or supplier, strikes, failures of the internet or payment services and government measures.

12.2 If the force majeure lasts longer than thirty days, the customer and the trader may dissolve the contract. The trader then refunds what the customer has already paid as soon as possible. Neither party is entitled to damages.

Article 13 Intellectual property

The copyright and other intellectual property rights in the books, the texts, the images and the webshop belong to the trader or the authors. Without prior written consent nothing may be reproduced, made public or used for commercial purposes, except to the extent permitted by law.

Article 14 Privacy

The trader processes personal data of the customer in accordance with the privacy statement at https://communicationinpractice.com/privacyverklaring-privacy-statement/. That statement is not part of these terms and conditions but explains which data the trader uses and why.

Article 15 Applicable law and disputes

15.1 Dutch law applies to all contracts between the trader and the customer. The United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention) is excluded.

15.2 A consumer who lives in another EU country keeps the protection of the mandatory provisions of the law of his country of residence.

15.3 Disputes with business customers are submitted to the District Court of Gelderland, location Nijmegen. For disputes with consumers, the jurisdiction that the law gives to the consumer applies.

Article 16 Amendments and final provisions

16.1 The version of these terms and conditions that applied at the time of the order applies to that order. The trader may amend the terms and conditions for future orders.
